三、教學目標 Objectives
由於世界智慧財產權組織提倡國際性的平衡及有效的智慧財產制度，以利創新及創造力來造福全人類，並管理含於WIPO公約內之26種公約及條約(如巴黎公約、專利法條約等),以利各國有共同的智慧財產制度規範及準則來保護其智慧財產權的發展。因此鼓勵、保護及管理智慧財產權已成每一國家經濟成長與社會福祉的重要政策之一。
本課程主要介紹世界智慧財產權組織(WIPO)及條約(如產業財產權保護之巴黎公約及文學及藝術作品著作權保護
之伯恩公約)，TRIPS(與貿易相關智慧財產權協),智慧財產權(intellectual property rights,IPR)意義及性質、範圍含專利(patent包括發明,新型,新式樣(或稱產業設計)、著作權(copyright)含著作經濟權及人格權)、商標(trademark含服務商標,地理區域標示GI)、營業秘密(trade secret)、積體電路布局保護法、科技移轉(technology transfer)等相關法規、智慧財產權管理(IPR management)等。
主要教學目標在使學生藉由了解智慧財產權相關知識及我國法規,國際條約相關規定及IPR管理及商業化過程對促進經濟發展之重要性,與其未來發展趨勢.
1.希望讓學生了解智慧財產權對產業競爭力的重要性,因其已成為國際性知識,或可說產業及個人必備之法律知識
2.對國際及一些國家(如美,日)和我國相關IPR法規及侵權案例、公司智慧財產權管理方法有所了解.
The world intellectual property organization(WIPO) promote development of a balanced and effective international intellectual property (IP) system that enables innovation and creativity for the benefit of all.It also manages and formulates related conventions(such as Paris Convention) and treaties (for example Patent Law Treaty ) for facilitating common rules in every country’s IPR Systems.
Thererfore,the courage, protection, and management of the intellectual property rights has become one of the important policies for the economic growth and social well-being in every country.IPR management has become one of the major source national competitiveness and the propellent of the economy development.
This course will introduce briefly WIPO IP policies,related conventions,the basics of the intellectual property rights(IPRs),its attributes,scope, related knowledge and laws,technology transfer ,IPR and innovation management.The IPRs include Patents, Industrial Designs,Trademarks, Geographical Indication(GI), Layout-designs (topographies) of Integrated Circuits, Copyright and rights related ,Trade Secret,etc,.
The teaching goals of this course will help students to study WIPO,USPTO,EPO,JPO and R.O.C.’s IPR laws ,related knowledge,infringement cases ,and some company IPR management methods.
