3. Introduction to Law & Legal System, 10th ed., Schubert;
4. Federal Rules of Civil Procedure;及
5. Federal Rules of Evidence。
In addition, US cases and reading materials on US Civil Procedure, and samples of some of the civil litigation cases handled by the teacher in the US in the past 30 years will be disseminated to the students by invitation per methods accepted by students.
三、教學目標 Objectives
老師會以 Chapter 1 of the Civil Procedure 8th Ed. by Yeazell, An Overview of Procedure ﹝第1頁至58頁﹞為本,以老師本人在美國從事民事商業訴訟逾三十年的實際案例及網路上能找到的文獻及案例為輔,並以英文及中文講述及鼓勵課堂討論的方式來讓學生瞭解美國民事商業訴訟的程序、思維方式、策略及實際訴狀,以增加學生協助台灣涉外民事訴訟當事人處理涉外民事訴訟之能力。
Teacher will use Chapter 1 of the Civil Procedure 8th Ed. by Yeazell (PP. 1 - 58) as the primary material, supplemented with his over 30 years business litigation cases in the US and materials and cases found in the internet to lecture and encourage class discussion in both English and Chinese so as to help students understand the procedure, logical thinking, strategies and actual pleadings of civil business litigation in the US, so as to increase their ability to assist people in Taiwan who are involved in foreign civil litigations.
四、課程內容 Course Description
整體敘述 Overall Description
這是我第四次教這一門課,也是第三次教大學部學生。我認為大學部學生應該偏重學術研究,但也考慮到學生缺乏美國的生活經驗及語言的能力。所以,我決定在大學部及研究所都採綜合講授及美國法律學校案例研討的方式來授課。但依過去的經驗,學生閱讀英文案例的能力有待加強。去年,我改採 Chapter 1 of the Civil Procedure 8th Ed. by Yeazell, An Overview of Procedure ﹝第1頁至58頁﹞為主要閱讀,並增加實務經驗的分享。效果相當好。所以,今年會採同樣的方式。以下的分週描述只是我希望能涵蓋的範疇及預估的進度,不代表實際上能涵蓋的範疇及進度。
期中及期末考都是 take home and open book。
我也顧慮到有一些在職專班的學生沒有修過相當的法律課程,白天工作辛苦,所以會以中文教學並視情況調整教學範疇及進度。
我也注意到,在台灣法律系課程的教學似乎還是以學術論述的方式為主,常令學生難以將所學與現實的情況結合。我也注意到,國內人,包括學生及學者,學習英文多以中翻英的方式,而英漢字辭典的翻譯多半不全,造成翻譯的錯誤及接著的觀念的錯誤。所以,我會試著以漸進及和緩的講述及討論的方式來讓學生更正確地瞭解美國民事商業訴訟的程序、思維方式、策略及訴狀格式。我期望這種教學方式能增進學生們將來協助台灣涉外民事訴訟當事人處理涉外民事商業訴訟之能力。
大部分的「講義」都是英文。但我不會期望學生能看得懂全部,甚至大部分。但,學生的英文程度越高,會越能夠吸收講義及上課時所提供的資訊。
