| 三、教學目標 Objectives |
| 為何川普總統行政權如此強大？司法要如何與其抗衡？立法權又能扮演什麼角色？歷史上，川普絕對不是第一個、也不會是最後一個嘗試擴張行政權的總統，因為在美國憲法的規範下，三權之間存在著緊張、衝突的關係，僵局，可能是被預期的，各個權力部門有其相互對抗的武器，這凸顯的不是立法優位、司法優位，而是切確之權力部門間的“平等相維”。本課程將聚焦於美國行政程序之相關規範及理論之介紹。並將針對機關決策之憲法正當性，以及其與立法部門、行政部門暨司法部門間之關係，進行探討。此外，並將針對政策決定下的行政裁量予以分析與說明。其中並包括行政正當程序的憲法基礎、司法審查的範疇為何、法規命令與行政裁決之異同、正當程序之局限性等。整部課程將以「美國聯邦行政程序法」為制度介紹之重要基礎。尤須說明者，此部制定於1946年的行政程序法，亦為我國行政程序法草擬時的重要參考。 |
| This course will focus on the aspects of the administrative process that are applied to almost all administrative agencies in U.S. Fundamental consideration is given to the constitutional justification for the administrative agency and the agency's relationship to the legislature, the executive, and, the courts. Moreover, administrative discretion to formulate policy and the manner in which policies are made will be introduced and analyzed. Specific topics include the constitutional basis of administrative procedure, the scope of judicial review, the difference between rulemaking and adjudication, the limits of procedural due process, as well as the construction of the Administrative Procedure Act. |
| 四、課程內容 Course Description |
●整體敘述 Overall Description
上課方式將先以教師授課為主，透過課程講解以及與學生討論，協助學生能夠藉由比較法的認識，了解與掌握行政法從總論到各論應有的基本認識、併比較法上的差異，以之作為後續學生分組報告時的基礎。因此，第二部份則將進行同學的分組報告。課程進行將對同學報告題目做初步審視，以釐清可能有的爭議，協助同學後續的處理與回應。報告的進行並將要求指定組別進行問題提問，其他同學亦可參與討論。報告的方式除了口頭報告外，書面報告部分將要求於期末繳交，且必須增補課堂上之相關提問以為回應。 |
